Personal Data Protection Law (KVKK) Clarification Text
The privacy and security of your data is based on the most legal foundation of our corporate business ethics.
Personal Data Protection and Processing Policy
Operating as a legal Private Employment Agency and corporate human resources intermediary firm subject to the regulations of the Turkish Employment Agency (ISKUR), Niğtem Consulting (Data Controller) shows the highest level of sensitivity to the security of the personal data of both our employer families requesting services and our personnel candidates (caregiver, housekeeper, chauffeur, gardener) applying to our pool for employment.
This Clarification Text has been prepared in accordance with the Personal Data Protection Law No. 6698 ("KVKK") to inform you about the purposes for which your personal data collected, stored, and processed by us in our capacity as the data controller are processed, to whom they can be transferred, the collection methods, and your legal rights.
1. Identity of the Data Controller
Within the scope of KVKK, the Data Controller is Niğtem Caregiving and Consulting Services, residing at the address "Sağlık Mah. Sağlık 1 Sk. Sağlık Ap. D:14/9 Çankaya / Ankara".
2. Your Processed Personal Data and Collection Methods
Within the scope of your corporate business partnership, personnel requests, or job applications with our company; your following data are legally collected through forms on our website, phone calls, WhatsApp communication line, e-mail, or physical interviews:
- Identity and Contact Information: Your name, surname, TR identity number, date of birth, phone number, e-mail address, and residence (domicile) information.
- Service and Request Information (For Employer Families): The scope of your personnel need (live-in or regular household order expectations), the location of your home, and operational details regarding the household structure.
- Professional and Resume Information (For Personnel Candidates): Your past work experiences, verifiable family/executive reference letters, educational status, specialization branches (patient care, child development, kitchen management, etc.), and professional documents such as driver's license/psychotechnical certificate.
- Special Categories of Personal Data: Legal criminal records (criminal history) requested from candidates in accordance with ISKUR legislation and home/clinical environment employment suitability standards, and health screening reports showing that there is no infectious disease or physical disability.
3. Purposes of Processing Personal Data
Your collected personal data are processed for the following corporate and legal purposes within the personal data processing conditions specified in Articles 5 and 6 of the KVKK:
- Analyzing the qualified personnel needs (live-in or regular assistant/caregiver) of our employer families and matching them with the most accurate candidate profiles,
- Verifying the criminal record, health, and retrospective work discipline references of our personnel candidates within the framework of our corporate security protocols,
- Fully fulfilling the Turkish Employment Agency (ISKUR) audits and legal reporting obligations,
- Executing corporate contracts regarding our intermediary activities, and conducting billing and financial processes,
- Increasing our service quality, tracking customer satisfaction feedbacks, and ensuring fast backup personnel (replacement) organization in emergencies.
4. To Whom and For What Purpose the Processed Personal Data Can Be Transferred
Niğtem Consulting absolutely protects the privacy of your personal data. Your collected data can only be transferred to the following third parties and institutions in accordance with KVKK principles:
Transfer of Candidate Data: The resumes and verified reference information of our personnel candidates are shared only with the relevant employer families requesting personnel for the purpose of obtaining recruitment and adaptation approvals. Apart from this, transfers are made to the Turkish Employment Agency (ISKUR), judicial authorities, or authorized official institutions and organizations within the limits of legal notification within the scope of obligations arising from legal regulations. They are never sold or rented to third parties for commercial purposes.
5. Legal Rights of Data Subjects Under KVKK
In accordance with Article 11 of the Law, you can exercise the following rights by applying to our company as a personal data subject:
- To learn whether your personal data is processed,
- To request information if your personal data has been processed,
- To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
- To know the third parties to whom personal data is transferred domestically or abroad,
- To request correction of personal data if it is processed incompletely or incorrectly,
- To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
- To object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,
- To request the compensation of the damage in case of damage due to the unlawful processing of personal data.
6. Application and Communication Method
You can submit your requests regarding your rights stated above to our corporate channels in writing, or via registered electronic mail (KEP) address, using secure electronic signature, or via the e-mail address you have previously notified to our company. Your applications will be concluded legally free of charge within 30 (thirty) days at the latest depending on the nature of the request.
